Privacy Policy

Ippan Shadan Hojin Corporate Action Japan (hereinafter referred to as “Our Association”) has established the following Privacy Policy (hereinafter referred to as the “Policy”) and handles personal information appropriately in accordance with the Policy.

Capitalized but undefined terms used in the Policy shall have the meanings given to them in, and shall be governed by, the Act on the Protection of Personal Information (hereinafter referred to as the “Act”).

Article 1 (Purpose of Use) Our Association shall use the Personal Information it has obtained to the extent necessary to achieve the following purposes of use.
(1) To engage and negotiate with listed companies and other companies in connection with Our Association’s activities;
(2) To collaborate, cooperate, correspond with investors, investors’ alliances and other organizations in connection with Our Association’s activities;
(3) To respond to inquiries to Our Association;
(4) To publicize and promote Our Association’s activities;
(5) To provide the Personal Information with third parties in the manner described in this Policy;
(6) To conduct various investigations and analyses necessary for the above mentioned purposes of use;
(7) With respect to the Personal Information of Our Association’s officers and employees (including those who are currently employed or serving out their positions, who are undergoing the screening process for employment, who have undergone the screening process for employment in the past, and who are retired. Hereinafter referred to as “Employees, etc.”) and their dependents, for the following purposes:
① Procedures required for the screening process for employment or employment management (including procedures for various business contracts, salary, remuneration and social insurance, procedures for benefits, procedures for personnel information changes according to congratulatory and condolence occasions and other events and safety management procedures);
② Necessary procedures for providing education and training opportunities for current employees, etc.;
③ Sending communications related to Our Association activities; and
(7) For any use incidental to each of the preceding items.
Article 2 (Third Party Provision) Our Association shall not provide any third party with the Personal Information obtained without first obtaining the prior consent of the individual, except for the cases set forth below. (1) Cases in which the provision of the Personal Information is based on laws and regulations;
(2) Cases in which the provision of the Personal Information is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the individual;
(3) Cases in which the provision of the Personal Information is specially necessary for improving public health or promoting the sound growth of children and in which it is difficult to obtain the consent of the individual;
(4) Cases in which the provision of the Personal Information is necessary for cooperating with a state organ, a local government, or an individual or a business operator entrusted by one in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the individual are likely to impede the execution of such affairs;
(5) Cases in which the disclosure of the Personal Information is requested by a court, public prosecutor’s office, police or any similar authority in accordance with proper procedures;
(6) Cases in which the third party to whom the personal information is provided is an academic research institution, etc. (university, other institution or organization for the purpose of academic research, or its member) and in which it is necessary to handle the personal information provided to the third party for the purpose of academic research (including cases where part of the purpose is for academic research purposes and excluding cases where there is a risk of unjust infringement of the rights and interests of individuals);
(7) Cases in which the Personal Data is provided in association with the outsourcing of all or part of the handling of the Personal Data within the scope necessary for the achievement of the purpose of use;
(8) Cases in which personal information is provided as a result of succession of business due to merger or other reasons and is handled within the scope of the purpose of use before the succession.
Article 3 (Security Control Measures) In order to prevent unauthorized access to Personal Information and leakage, loss, or damage of Personal Information, Our Association shall establish organizational, personal, physical, and technical security measures, implement necessary and appropriate measures, and appropriately manage Personal Information and specific Personal Information.
Article 4 (Request for Disclosure, Suspension, Suspension of Use, Etc. of Personal Data, Inquiries, Complaints, Etc.) 1. If a request for disclosure, correction, addition, deletion, suspension of use, or erasure of the Personal Data held by Our Association is made pursuant to the Act, we shall confirm that such request is made by the individual and that the requirements set forth in the said Act are satisfied, and then disclose such information without delay or correct or suspend use to the extent necessary. Provided, however, that this shall not apply if Our Association does not assume these obligations under the said laws and regulations.

Article 5 (Amendment) Our Association may revise this Privacy Policy to protect the Personal Information of customers, etc. and to comply with changes in laws and regulations and other rules.
